住建部關于推進工程建設項目審批標準化規范化便利化的通知

      為貫徹落實《國務院關于加快推進政務服務標準化規范化便利化的指導意見》(國發〔2022〕5號)和《國務院辦公廳關于進一步優化營商環境降低市場主體制度性交易成本的意見》(國辦發〔2022〕30號)部署要求,加快推進房屋建筑和城市基礎設施等工程建設項目審批標準化、規范化、便利化,進一步提升審批服務效能,更好滿足企業和群眾辦事需求,加快項目落地,現就一、大力推進審批標準化規范化

(一(yi))加強(qiang)審(shen)批(pi)事(shi)(shi)(shi)項管理(li)。按照(zhao)國務院(yuan)關于行政(zheng)許可事(shi)(shi)(shi)項、政(zheng)務服務事(shi)(shi)(shi)項清(qing)(qing)單(dan)管理(li)要求,結合(he)本地實(shi)際(ji),進(jin)一(yi)步優(you)化(hua)完善工程(cheng)(cheng)建(jian)設項目(mu)(mu)審(shen)批(pi)事(shi)(shi)(shi)項清(qing)(qing)單(dan),并與投資審(shen)批(pi)事(shi)(shi)(shi)項清(qing)(qing)單(dan)做好銜接,將(jiang)工程(cheng)(cheng)建(jian)設項目(mu)(mu)全流(liu)程(cheng)(cheng)涉(she)及的(de)行政(zheng)許可、行政(zheng)確(que)認、行政(zheng)備(bei)案、第三方(fang)機構(gou)審(shen)查(cha)、市政(zheng)公(gong)用報裝(zhuang)接入等(deng)事(shi)(shi)(shi)項全部(bu)納(na)入清(qing)(qing)單(dan),確(que)保事(shi)(shi)(shi)項清(qing)(qing)單(dan)外無(wu)審(shen)批(pi)。推動事(shi)(shi)(shi)項實(shi)施規(gui)范統(tong)一(yi),根據國務院(yuan)有關部(bu)門制定(ding)的(de)行政(zheng)許可事(shi)(shi)(shi)項實(shi)施規(gui)范,逐項修改完善本地區(qu)工程(cheng)(cheng)建(jian)設項目(mu)(mu)審(shen)批(pi)事(shi)(shi)(shi)項辦(ban)事(shi)(shi)(shi)指(zhi)南、申請表單(dan)等(deng),明確(que)申請條件、申請材料、辦(ban)理(li)流(liu)程(cheng)(cheng)、辦(ban)理(li)時限,細化(hua)量化(hua)受理(li)審(shen)查(cha)標(biao)準,并向社會公(gong)開,加快實(shi)現同(tong)一(yi)事(shi)(shi)(shi)項無(wu)差別(bie)受理(li)、同(tong)標(biao)準辦(ban)理(li)。

(二(er))提升審(shen)(shen)(shen)批(pi)服(fu)(fu)務(wu)水平。加強(qiang)工程(cheng)建(jian)設(she)項(xiang)目(mu)審(shen)(shen)(shen)批(pi)窗口人員業務(wu)培訓,增強(qiang)窗口服(fu)(fu)務(wu)意識,嚴(yan)格(ge)執行首問(wen)負責、一次性(xing)告知(zhi)、限時辦結等(deng)(deng)制(zhi)(zhi)度,鼓勵提供幫辦、代(dai)辦、預約辦等(deng)(deng)個(ge)性(xing)化服(fu)(fu)務(wu)。嚴(yan)格(ge)按照公(gong)(gong)布的辦理(li)流(liu)程(cheng)和(he)(he)實施規范開展審(shen)(shen)(shen)批(pi),不得額(e)外(wai)增加或變相增加辦理(li)環(huan)節、申請材(cai)料等(deng)(deng)。對審(shen)(shen)(shen)批(pi)涉及(ji)的技術審(shen)(shen)(shen)查、現場(chang)勘驗、聽(ting)證(zheng)論證(zheng)等(deng)(deng)實行清單化管理(li),建(jian)立限時辦結機制(zhi)(zhi)并向(xiang)社會公(gong)(gong)開。持續(xu)整治“體外(wai)循環(huan)”和(he)(he)“隱性(xing)審(shen)(shen)(shen)批(pi)”問(wen)題(ti),嚴(yan)禁申報前(qian)增加預審(shen)(shen)(shen)、指(zhi)定機構事(shi)先審(shen)(shen)(shen)查、線(xian)下預審(shen)(shen)(shen)線(xian)上補錄等(deng)(deng)行為。各地應(ying)建(jian)立健全工程(cheng)建(jian)設(she)項(xiang)目(mu)審(shen)(shen)(shen)批(pi)監(jian)(jian)督(du)管理(li)機制(zhi)(zhi),落實責任分(fen)工,明確違規情(qing)形和(he)(he)問(wen)題(ti)處(chu)置(zhi)機制(zhi)(zhi),通過監(jian)(jian)督(du)抽(chou)查、電(dian)子(zi)監(jian)(jian)察(cha)等(deng)(deng)多種方式對審(shen)(shen)(shen)批(pi)行為進(jin)行常態(tai)化監(jian)(jian)管,及(ji)時分(fen)析研判審(shen)(shen)(shen)批(pi)各環(huan)節存(cun)在的問(wen)題(ti),并推(tui)動(dong)解決(jue)。

(三)規(gui)(gui)(gui)范審(shen)批(pi)(pi)(pi)(pi)服務(wu)辦理用(yong)時(shi)(shi)。梳(shu)理并公開(kai)本地區工程建設項目從立項到竣工驗收和市(shi)政公用(yong)報裝接入全流程審(shen)批(pi)(pi)(pi)(pi)服務(wu)事項辦理用(yong)時(shi)(shi),明確(que)起(qi)止時(shi)(shi)點、計(ji)(ji)時(shi)(shi)規(gui)(gui)(gui)則(ze)等,包括行政許可(ke)用(yong)時(shi)(shi),審(shen)批(pi)(pi)(pi)(pi)部門組(zu)織、委托或購買服務(wu)的(de)技術審(shen)查、專家評審(shen)、會議審(shen)查、現(xian)場勘驗等用(yong)時(shi)(shi)。不得通過“體外(wai)循環(huan)”審(shen)批(pi)(pi)(pi)(pi)、違規(gui)(gui)(gui)暫停(ting)審(shen)批(pi)(pi)(pi)(pi)計(ji)(ji)時(shi)(shi)或變通審(shen)批(pi)(pi)(pi)(pi)時(shi)(shi)限(xian)計(ji)(ji)算(suan)規(gui)(gui)(gui)則(ze)等方式“表面”壓(ya)減審(shen)批(pi)(pi)(pi)(pi)時(shi)(shi)間。

二、持續提升審批便利度

(四)深(shen)化(hua)(hua)區(qu)(qu)域評估(gu)(gu)(gu)。區(qu)(qu)域評估(gu)(gu)(gu)成果經相(xiang)關主管(guan)部門確認后(hou)及(ji)時公開,供(gong)建設單(dan)(dan)位免費使用(yong)(yong)(yong)。明(ming)確根據區(qu)(qu)域評估(gu)(gu)(gu)簡化(hua)(hua)單(dan)(dan)個項目(mu)相(xiang)應(ying)(ying)(ying)審批手續的(de)具體情形和規則(ze)。鼓勵推行(xing)(xing)社會投資項目(mu)“用(yong)(yong)(yong)地(di)(di)清(qing)單(dan)(dan)制”改革,在(zai)土地(di)(di)供(gong)應(ying)(ying)(ying)前,可(ke)由相(xiang)關部門開展地(di)(di)質災害、地(di)(di)震安全、壓(ya)覆礦(kuang)產、氣(qi)候(hou)可(ke)行(xing)(xing)性、水資源論證(zheng)、防洪、考古(gu)調查(cha)勘(kan)探發掘(jue)等評估(gu)(gu)(gu),并對文物、歷史建筑(zhu)保護對象、古(gu)樹名(ming)木、人防工程、地(di)(di)下管(guan)線等進行(xing)(xing)現狀普查(cha),形成評估(gu)(gu)(gu)結果和普查(cha)意見清(qing)單(dan)(dan),在(zai)土地(di)(di)供(gong)應(ying)(ying)(ying)時一并交付用(yong)(yong)(yong)地(di)(di)單(dan)(dan)位,避(bi)免用(yong)(yong)(yong)地(di)(di)單(dan)(dan)位拿地(di)(di)后(hou)重復論證(zheng)。

(五)分類(lei)優化(hua)(hua)精簡審(shen)(shen)(shen)批(pi)環節。進一步(bu)優化(hua)(hua)建設工(gong)程(cheng)規劃許(xu)可(設計方案審(shen)(shen)(shen)查(cha)(cha))等事(shi)項審(shen)(shen)(shen)批(pi)流(liu)程(cheng),統一規范會議(yi)審(shen)(shen)(shen)議(yi)情形及(ji)時限(xian),減少(shao)非必要的政府會議(yi)審(shen)(shen)(shen)核程(cheng)序(xu)。結合實際優化(hua)(hua)既有(you)建筑改造、老舊小區(qu)改造、市政管網更新改造等城市更新項目(mu)審(shen)(shen)(shen)批(pi)流(liu)程(cheng),對無需(xu)辦理施(shi)工(gong)圖審(shen)(shen)(shen)查(cha)(cha)、建設工(gong)程(cheng)規劃許(xu)可的,應細(xi)化(hua)(hua)項目(mu)類(lei)型和具體(ti)條件。

(六)推(tui)進(jin)集成聯(lian)合辦理。進(jin)一(yi)(yi)步優化階段并聯(lian)審(shen)(shen)(shen)(shen)批(pi)協同機制,推(tui)動更(geng)多關(guan)聯(lian)性強、辦事需求量大的審(shen)(shen)(shen)(shen)批(pi)事項集成化辦理。進(jin)一(yi)(yi)步優化施(shi)工(gong)(gong)圖聯(lian)合審(shen)(shen)(shen)(shen)查(cha)機制,審(shen)(shen)(shen)(shen)查(cha)機構出具(ju)消防(fang)(fang)(fang)、人防(fang)(fang)(fang)、技(ji)防(fang)(fang)(fang)等技(ji)術(shu)審(shen)(shen)(shen)(shen)查(cha)報(bao)告后,相(xiang)關(guan)審(shen)(shen)(shen)(shen)批(pi)部(bu)(bu)門(men)不再進(jin)行技(ji)術(shu)審(shen)(shen)(shen)(shen)查(cha)。鼓(gu)勵(li)施(shi)工(gong)(gong)許可、質(zhi)量監(jian)(jian)督、人防(fang)(fang)(fang)質(zhi)量監(jian)(jian)督、消防(fang)(fang)(fang)設計審(shen)(shen)(shen)(shen)查(cha)等聯(lian)合辦理。進(jin)一(yi)(yi)步優化聯(lian)合驗(yan)(yan)收(shou)(shou)方式(shi),未(wei)經驗(yan)(yan)收(shou)(shou)不得投入(ru)使(shi)(shi)用的事項(如規劃核實(shi)、人防(fang)(fang)(fang)備(bei)案、消防(fang)(fang)(fang)驗(yan)(yan)收(shou)(shou)、消防(fang)(fang)(fang)備(bei)案、竣工(gong)(gong)備(bei)案、檔案驗(yan)(yan)收(shou)(shou)等)原則上應當納入(ru)聯(lian)合驗(yan)(yan)收(shou)(shou),工(gong)(gong)程質(zhi)量竣工(gong)(gong)驗(yan)(yan)收(shou)(shou)監(jian)(jian)督可納入(ru)聯(lian)合驗(yan)(yan)收(shou)(shou)階段同步開(kai)展,牽頭部(bu)(bu)門(men)統(tong)一(yi)(yi)受理驗(yan)(yan)收(shou)(shou)申(shen)請,協調專項驗(yan)(yan)收(shou)(shou)部(bu)(bu)門(men)限時(shi)開(kai)展聯(lian)合驗(yan)(yan)收(shou)(shou),統(tong)一(yi)(yi)出具(ju)驗(yan)(yan)收(shou)(shou)意見。在(zai)符(fu)合項目整體質(zhi)量安全要求、達(da)到安全使(shi)(shi)用條件的前提下,對滿足(zu)使(shi)(shi)用功(gong)能(neng)的單(dan)位工(gong)(gong)程,可單(dan)獨(du)開(kai)展聯(lian)合驗(yan)(yan)收(shou)(shou)。

(七(qi))優化市政公(gong)用(yong)服(fu)(fu)務(wu)。大力推進(jin)(jin)水(shui)電氣熱信聯合(he)報(bao)裝(zhuang)接入(ru),實(shi)(shi)行“一站(zhan)式”集(ji)中(zhong)服(fu)(fu)務(wu)、主動(dong)服(fu)(fu)務(wu),進(jin)(jin)一步(bu)優化報(bao)裝(zhuang)接入(ru)服(fu)(fu)務(wu)流程(cheng),精簡申報(bao)材料(liao),公(gong)開(kai)服(fu)(fu)務(wu)標(biao)準(zhun)和服(fu)(fu)務(wu)費用(yong),加(jia)強服(fu)(fu)務(wu)監督,提高服(fu)(fu)務(wu)效率。建立市政配(pei)套統(tong)籌協調機制,推動(dong)市政公(gong)用(yong)單位在項目(mu)策劃生成階段提前主動(dong)開(kai)展技術(shu)指導,落(luo)實(shi)(shi)接線位置。對于市政公(gong)用(yong)接入(ru)工程(cheng)涉及的建設工程(cheng)規劃許可、城市綠地樹木審批、道路挖(wa)掘占用(yong)許可等(deng)實(shi)(shi)行全程(cheng)并(bing)聯辦理(li)。

三、進一(yi)步(bu)優(you)化網(wang)上審批服務能力

(八)提升網(wang)(wang)上(shang)辦(ban)事深度(du)。深化工(gong)程(cheng)(cheng)(cheng)(cheng)建(jian)設項目審(shen)(shen)(shen)批(pi)(pi)管理(li)系統(tong)(tong)(tong)(以(yi)下(xia)簡稱工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)系統(tong)(tong)(tong))應用(yong)(yong),持續推(tui)動工(gong)程(cheng)(cheng)(cheng)(cheng)建(jian)設項目全(quan)流(liu)程(cheng)(cheng)(cheng)(cheng)在線(xian)審(shen)(shen)(shen)批(pi)(pi)。2023年(nian)底前實(shi)現工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)系統(tong)(tong)(tong)覆蓋全(quan)部縣(區),消防設計審(shen)(shen)(shen)查(cha)驗收(shou)全(quan)部納入工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)系統(tong)(tong)(tong)。進一步完善(shan)工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)系統(tong)(tong)(tong)功能,更好支撐審(shen)(shen)(shen)批(pi)(pi)部門業務需求(qiu)和工(gong)作(zuo)特點(dian),推(tui)廣線(xian)上(shang)智能引導、智能客(ke)服(fu)等輔(fu)助申報方式,提高(gao)企(qi)業咨詢、查(cha)詢、填報、反饋(kui)等辦(ban)事便利度(du)。在工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)系統(tong)(tong)(tong)開通(tong)市政公(gong)用(yong)(yong)聯合(he)報裝(zhuang)、外(wai)線(xian)接入工(gong)程(cheng)(cheng)(cheng)(cheng)審(shen)(shen)(shen)批(pi)(pi)等集成(cheng)化服(fu)務,拓展移(yi)動端應用(yong)(yong),加快由網(wang)(wang)上(shang)可辦(ban)向全(quan)程(cheng)(cheng)(cheng)(cheng)網(wang)(wang)辦(ban)、好辦(ban)易辦(ban)轉(zhuan)變(bian)。

(九)加(jia)(jia)強數(shu)據共享應(ying)用(yong)。進一(yi)步完善(shan)工程審批系統與投資、規劃用(yong)地(di)、生態(tai)環境、市政(zheng)公用(yong)等系統的信(xin)息(xi)共享、協同(tong)應(ying)用(yong)機制,堅決杜(du)絕重復登錄、重復錄入問(wen)題。大力推(tui)進工程建(jian)設項(xiang)目全流程數(shu)字化報建(jian),加(jia)(jia)快(kuai)推(tui)進電子(zi)(zi)簽名、電子(zi)(zi)印章(zhang)、電子(zi)(zi)證(zheng)照(zhao)(zhao)、電子(zi)(zi)材(cai)料、電子(zi)(zi)檔案(an)在網上辦理過程中的歸集共享,推(tui)動實現政(zheng)府部門核發的材(cai)料一(yi)律免(mian)于(yu)提(ti)交(jiao),能夠提(ti)供電子(zi)(zi)證(zheng)照(zhao)(zhao)的一(yi)律免(mian)于(yu)提(ti)交(jiao)實體證(zheng)照(zhao)(zhao)。

(十)推進智能(neng)輔(fu)助(zhu)審(shen)(shen)查(cha)。推進工程建(jian)(jian)設(she)(she)圖(tu)(tu)紙(zhi)設(she)(she)計(ji)、施(shi)工、變更、驗(yan)收(shou)、檔(dang)案(an)移交全(quan)過程數(shu)字化管理(li),實現工程建(jian)(jian)設(she)(she)項目(mu)全(quan)程“一(yi)張(zhang)圖(tu)(tu)”管理(li)和協同應用。鼓勵(li)有(you)條件(jian)的地區在(zai)(zai)設(she)(she)計(ji)方案(an)審(shen)(shen)查(cha)、施(shi)工圖(tu)(tu)設(she)(she)計(ji)文件(jian)審(shen)(shen)查(cha)、竣工驗(yan)收(shou)、檔(dang)案(an)移交環節(jie)采用建(jian)(jian)筑信息模型(BIM)成(cheng)果提交和智能(neng)輔(fu)助(zhu)審(shen)(shen)批(pi),加強BIM在(zai)(zai)建(jian)(jian)筑全(quan)生命周期管理(li)的應用。

四、加強(qiang)事中事后(hou)監管(guan)

(十一)推(tui)進審(shen)管(guan)(guan)聯動。健全審(shen)管(guan)(guan)銜接(jie)機制,對于實行相(xiang)對集中行政許可權(quan)改(gai)革的地區(qu),各地應逐事(shi)項(xiang)明確(que)審(shen)批(pi)(pi)、監管(guan)(guan)的職責(ze)和邊界,加強協同(tong)配合,加快推(tui)動審(shen)批(pi)(pi)和監管(guan)(guan)信息實時共享。要(yao)明確(que)容缺(que)受理和告(gao)知承諾制審(shen)批(pi)(pi)事(shi)項(xiang)的工(gong)作規程和監管(guan)(guan)規則(ze),在規定(ding)時間內對補正材料情況和履(lv)行告(gao)知承諾情況進行檢查,發現不實承諾、違反承諾、弄虛(xu)作假的,要(yao)依(yi)法責(ze)令限期整改(gai)或撤(che)銷(xiao)行政審(shen)批(pi)(pi)決定(ding),并追究申請(qing)人相(xiang)應責(ze)任(ren)。

(十(shi)二)創新監(jian)(jian)管(guan)方式(shi)。完(wan)善基(ji)于工(gong)(gong)程(cheng)風(feng)險的(de)分(fen)類(lei)監(jian)(jian)管(guan)機(ji)制(zhi)(zhi)(zhi),根(gen)據(ju)工(gong)(gong)程(cheng)類(lei)型(xing)、規模大小、技術復雜程(cheng)度、人(ren)員密(mi)集(ji)程(cheng)度、參建(jian)單(dan)(dan)位等(deng)(deng)因素確(que)定(ding)工(gong)(gong)程(cheng)風(feng)險等(deng)(deng)級(ji),按照(zhao)風(feng)險等(deng)(deng)級(ji)合理確(que)定(ding)重點檢查(cha)和隨機(ji)抽查(cha)比例和頻(pin)次。加(jia)(jia)強信(xin)(xin)用(yong)監(jian)(jian)管(guan),強化工(gong)(gong)程(cheng)建(jian)設項(xiang)(xiang)目相關市場主(zhu)體(ti)信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)歸集(ji),拓展多元(yuan)化信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)查(cha)詢渠道,實(shi)現信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)在審(shen)批過程(cheng)中(zhong)的(de)自動核查(cha)與反饋(kui)。大力(li)推(tui)進(jin)“互(hu)聯網+監(jian)(jian)管(guan)”,加(jia)(jia)快(kuai)建(jian)立單(dan)(dan)體(ti)房(fang)屋建(jian)筑(zhu)編(bian)碼賦碼用(yong)碼機(ji)制(zhi)(zhi)(zhi),推(tui)動工(gong)(gong)程(cheng)審(shen)批系統與建(jian)筑(zhu)市場公共服務平(ping)臺(tai)、質量(liang)安全監(jian)(jian)管(guan)平(ping)臺(tai)、智(zhi)慧工(gong)(gong)地(di)、房(fang)屋安全管(guan)理等(deng)(deng)系統互(hu)聯互(hu)通、協同(tong)應用(yong),建(jian)立工(gong)(gong)程(cheng)建(jian)設項(xiang)(xiang)目設計、施工(gong)(gong)、驗收、運營維護(hu)全生(sheng)命周期數字化監(jian)(jian)管(guan)機(ji)制(zhi)(zhi)(zhi)。加(jia)(jia)快(kuai)推(tui)進(jin)工(gong)(gong)程(cheng)審(shen)批系統向建(jian)設工(gong)(gong)程(cheng)企業(ye)資質審(shen)批系統共享工(gong)(gong)程(cheng)項(xiang)(xiang)目數據(ju)信(xin)(xin)息(xi)(xi)。

(十三(san))加(jia)(jia)強(qiang)組織協(xie)調。各(ge)地要充(chong)分(fen)認識工(gong)程建設項(xiang)目審批(pi)制(zhi)度(du)改革對(dui)促(cu)進投資(zi)建設、優化營商(shang)環境的重要意義(yi),加(jia)(jia)強(qiang)組織領導,充(chong)實工(gong)作(zuo)力量(liang),持續推動改革不(bu)斷深化。各(ge)級工(gong)程建設項(xiang)目審批(pi)制(zhi)度(du)改革牽頭部(bu)門(men)要主動作(zuo)為,加(jia)(jia)強(qiang)與(yu)相關部(bu)門(men)的協(xie)同配(pei)合(he),完善工(gong)作(zuo)機制(zhi),健全配(pei)套制(zhi)度(du),及(ji)時協(xie)調解決(jue)改革工(gong)作(zuo)推進過(guo)程中的矛盾(dun)問題,形成改革合(he)力。鼓勵各(ge)地開展工(gong)程建設項(xiang)目標準化審批(pi)試點,我部(bu)將及(ji)時總(zong)結推廣各(ge)地形成的典型經驗和創新做法。
