住建部關于進一步加強建設工程企業資質審批管理工作的通知

各省、自治區住房(fang)(fang)城鄉建(jian)(jian)設廳,直轄市住房(fang)(fang)城鄉建(jian)(jian)設(管)委,北京(jing)市規(gui)劃和自然(ran)資源(yuan)委,新疆生產(chan)建(jian)(jian)設兵團住房(fang)(fang)城鄉建(jian)(jian)設局,國(guo)務院有關(guan)部門,有關(guan)中央企業:

為深入貫徹落實黨(dang)的二十大(da)精神,扎實推進建筑業高質(zhi)量(liang)發展,切實保(bao)證工(gong)程質(zhi)量(liang)安(an)全和人(ren)民生命(ming)財產安(an)全,規范市(shi)場(chang)秩序,激(ji)發企(qi)業活力(li),現就(jiu)進一(yi)步加強建設工(gong)程企(qi)業資質(zhi)審批管理(li)工(gong)作通(tong)知如下。

一、提高(gao)(gao)資(zi)(zi)質審(shen)批效率。住房(fang)城鄉(xiang)建(jian)設主管部門和有關(guan)專(zhuan)業(ye)部門要(yao)積極完善企(qi)(qi)業(ye)資(zi)(zi)質審(shen)批機制,提高(gao)(gao)企(qi)(qi)業(ye)資(zi)(zi)質審(shen)查信息(xi)化(hua)水(shui)平,提升(sheng)審(shen)批效率,確保(bao)按(an)時作出(chu)審(shen)批決定。住房(fang)城鄉(xiang)建(jian)設部負(fu)責審(shen)批的(de)企(qi)(qi)業(ye)資(zi)(zi)質,2個月(yue)內完成(cheng)專(zhuan)家評審(shen)、公示審(shen)查結(jie)果,企(qi)(qi)業(ye)可登錄住房(fang)城鄉(xiang)建(jian)設部政務服務門戶(hu),點擊“申(shen)請事項辦理(li)進度(du)查詢(xun)(受理(li)發證信息(xi)查詢(xun))”欄目查詢(xun)審(shen)批進度(du)和結(jie)果。

二、統一(yi)全國資(zi)質(zhi)(zhi)審批(pi)權限。自本通(tong)知施(shi)行之日起(qi),企業資(zi)質(zhi)(zhi)審批(pi)權限下(xia)放試(shi)點(dian)(dian)地(di)(di)(di)區不再受(shou)理(li)試(shi)點(dian)(dian)資(zi)質(zhi)(zhi)申(shen)請(qing)(qing)事項,統一(yi)由住房城鄉建設部(bu)實施(shi)。試(shi)點(dian)(dian)地(di)(di)(di)區已受(shou)理(li)的(de)申(shen)請(qing)(qing)事項應在(zai)規定時間(jian)內(nei)審批(pi)辦結。試(shi)點(dian)(dian)期(qi)間(jian)頒發的(de)資(zi)質(zhi)(zhi),在(zai)資(zi)質(zhi)(zhi)證(zheng)書(shu)有效期(qi)屆(jie)滿前(qian)繼續(xu)有效,對企業依法處以停業整(zheng)頓、降(jiang)低資(zi)質(zhi)(zhi)等級、吊(diao)銷或撤銷資(zi)質(zhi)(zhi)證(zheng)書(shu)的(de),由試(shi)點(dian)(dian)地(di)(di)(di)區住房城鄉建設主管部(bu)門(men)實施(shi)。

三、加強企(qi)業(ye)(ye)重組分立及合并(bing)資(zi)(zi)(zi)質(zhi)(zhi)核(he)定。企(qi)業(ye)(ye)因發生(sheng)重組分立申請(qing)資(zi)(zi)(zi)質(zhi)(zhi)核(he)定的,需對原企(qi)業(ye)(ye)和資(zi)(zi)(zi)質(zhi)(zhi)承繼企(qi)業(ye)(ye)按資(zi)(zi)(zi)質(zhi)(zhi)標(biao)準進行考核(he)。企(qi)業(ye)(ye)因發生(sheng)合并(bing)申請(qing)資(zi)(zi)(zi)質(zhi)(zhi)核(he)定的,需對企(qi)業(ye)(ye)資(zi)(zi)(zi)產(chan)、人員及相關法律關系等情況進行考核(he)。

四、完(wan)善業(ye)(ye)(ye)(ye)績(ji)認(ren)定方式。申請(qing)由住(zhu)房城鄉建(jian)設(she)部(bu)(bu)負(fu)責審批的(de)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)資(zi)(zi)質(zhi),其(qi)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)業(ye)(ye)(ye)(ye)績(ji)應(ying)當是在(zai)全(quan)國(guo)建(jian)筑市(shi)場監(jian)管(guan)公共服務平(ping)(ping)(ping)臺(tai)(以下簡稱全(quan)國(guo)建(jian)筑市(shi)場平(ping)(ping)(ping)臺(tai))上滿(man)足(zu)(zu)資(zi)(zi)質(zhi)標(biao)準要(yao)求的(de)A級工(gong)程項(xiang)目(mu)(mu),專業(ye)(ye)(ye)(ye)技術人員(yuan)個(ge)人業(ye)(ye)(ye)(ye)績(ji)應(ying)當是在(zai)全(quan)國(guo)建(jian)筑市(shi)場平(ping)(ping)(ping)臺(tai)上滿(man)足(zu)(zu)資(zi)(zi)質(zhi)標(biao)準要(yao)求的(de)A級或B級工(gong)程項(xiang)目(mu)(mu)。業(ye)(ye)(ye)(ye)績(ji)未錄入全(quan)國(guo)建(jian)筑市(shi)場平(ping)(ping)(ping)臺(tai)的(de),申請(qing)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)需在(zai)提交(jiao)資(zi)(zi)質(zhi)申請(qing)前由業(ye)(ye)(ye)(ye)績(ji)項(xiang)目(mu)(mu)所在(zai)地省級住(zhu)房城鄉建(jian)設(she)主管(guan)部(bu)(bu)門確(que)認(ren)業(ye)(ye)(ye)(ye)績(ji)指(zhi)標(biao)真實性(xing)。自2024年(nian)1月1日起,申請(qing)資(zi)(zi)質(zhi)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)的(de)業(ye)(ye)(ye)(ye)績(ji)應(ying)當錄入全(quan)國(guo)建(jian)筑市(shi)場平(ping)(ping)(ping)臺(tai)。申請(qing)由有關專業(ye)(ye)(ye)(ye)部(bu)(bu)門配合實施審查的(de)企(qi)(qi)(qi)業(ye)(ye)(ye)(ye)資(zi)(zi)質(zhi),相關業(ye)(ye)(ye)(ye)績(ji)由有關專業(ye)(ye)(ye)(ye)部(bu)(bu)門負(fu)責確(que)認(ren)。

五、加大企業資質動(dong)態核查力(li)度(du)。住房城鄉(xiang)建設主(zhu)管(guan)部門要(yao)完善信息化手段,對企業注(zhu)(zhu)冊人員等(deng)開展動(dong)態核查,及時公(gong)開核查信息。經核查,企業不滿足資質標準(zhun)要(yao)求的(de),在全(quan)國建筑市(shi)場平臺上標注(zhu)(zhu)資質異(yi)常(chang),并限期整改(gai)。企業整改(gai)后(hou)滿足資質標準(zhun)要(yao)求的(de),取消(xiao)標注(zhu)(zhu)。標注(zhu)(zhu)期間,企業不得(de)申(shen)請辦理企業資質許(xu)可事項。

六、強(qiang)化建(jian)筑業(ye)企業(ye)資(zi)(zi)質(zhi)注(zhu)冊(ce)人員考核要求(qiu)。申請施工總承(cheng)包一(yi)級(ji)資(zi)(zi)質(zhi)、專業(ye)承(cheng)包一(yi)級(ji)資(zi)(zi)質(zhi)的(de)企業(ye),應當滿(man)足《建(jian)筑業(ye)企業(ye)資(zi)(zi)質(zhi)標準》(建(jian)市〔2014〕159號)要求(qiu)的(de)注(zhu)冊(ce)建(jian)造師人數(shu)等指標要求(qiu)。

七(qi)、加(jia)強(qiang)(qiang)信用管理。對(dui)存(cun)在資(zi)質申(shen)請弄虛作假行為、發生工(gong)程(cheng)質量(liang)安全責(ze)任(ren)事故、拖欠農民工(gong)工(gong)資(zi)等(deng)違反法律(lv)法規和工(gong)程(cheng)建設強(qiang)(qiang)制(zhi)性標(biao)準(zhun)的(de)企業(ye)(ye)和從業(ye)(ye)人(ren)員(yuan),住房城(cheng)鄉建設主(zhu)管部門要(yao)加(jia)大懲戒力度(du),依(yi)法依(yi)規限(xian)制(zhi)或禁止從業(ye)(ye),并(bing)列入(ru)信用記錄。企業(ye)(ye)在申(shen)請資(zi)質時(shi),應當對(dui)法定(ding)代(dai)表人(ren)、實(shi)際控制(zhi)人(ren)、技(ji)術負責(ze)人(ren)、項目負責(ze)人(ren)、注(zhu)冊人(ren)員(yuan)等(deng)申(shen)報材(cai)料的(de)真實(shi)性進行承諾,并(bing)授權住房城(cheng)鄉建設主(zhu)管部門核查(cha)社(she)保、納稅(shui)等(deng)信息。

八、建立函(han)詢制度(du)。住房城鄉建設主管部門可就資質申(shen)(shen)請相關(guan)投(tou)訴舉報、申(shen)(shen)報材(cai)料等問題向企(qi)業(ye)發(fa)函(han)問詢,被函(han)詢的(de)企(qi)業(ye)應(ying)如實(shi)對有關(guan)問題進行(xing)說明。經(jing)函(han)詢,企(qi)業(ye)承認在資質申(shen)(shen)請中填報內容不實(shi)的(de),按不予許可辦結(jie)。

九(jiu)、強化平(ping)臺(tai)數(shu)(shu)據(ju)監(jian)管(guan)責(ze)任。住房城(cheng)(cheng)鄉建設(she)主(zhu)管(guan)部門(men)要加(jia)強對全(quan)國(guo)建筑市場(chang)平(ping)臺(tai)數(shu)(shu)據(ju)的(de)監(jian)管(guan),落實(shi)(shi)平(ping)臺(tai)數(shu)(shu)據(ju)錄(lu)(lu)入審核(he)人員(yuan)(yuan)責(ze)任,加(jia)強對項目和人員(yuan)(yuan)業(ye)績信(xin)息(xi)的(de)核(he)實(shi)(shi)。全(quan)國(guo)建筑市場(chang)平(ping)臺(tai)項目信(xin)息(xi)數(shu)(shu)據(ju)不得擅自變(bian)更、刪除(chu),數(shu)(shu)據(ju)變(bian)化記錄(lu)(lu)永久保(bao)存。住房城(cheng)(cheng)鄉建設(she)部將以實(shi)(shi)地核(he)查、遙(yao)感(gan)衛星(xing)監(jian)測等方式抽查復(fu)核(he)項目信(xin)息(xi),加(jia)大對虛假(jia)信(xin)息(xi)的(de)處理力度,并按有關規(gui)定追究(jiu)責(ze)任。

十、加(jia)強(qiang)黨風廉政建(jian)設。住(zhu)房(fang)城鄉建(jian)設主管(guan)部(bu)門要(yao)完善(shan)企業資質審批(pi)(pi)權力運(yun)行(xing)和制(zhi)約監(jian)督(du)機(ji)制(zhi),嚴格審批(pi)(pi)程(cheng)序,強(qiang)化對審批(pi)(pi)工作人員、資質審查專家的廉政教育和監(jian)督(du)管(guan)理,建(jian)立健全(quan)追責機(ji)制(zhi)。推進企業資質智能化審批(pi)(pi),實(shi)現審批(pi)(pi)工作全(quan)程(cheng)留痕(hen),切實(shi)防止發生企業資質審批(pi)(pi)違(wei)法違(wei)紀違(wei)規行(xing)為。

本(ben)通(tong)(tong)(tong)(tong)知(zhi)自2023年9月15日起施行。《住房城(cheng)(cheng)鄉建(jian)(jian)(jian)(jian)(jian)設部關(guan)(guan)于(yu)建(jian)(jian)(jian)(jian)(jian)設工(gong)程企(qi)(qi)業(ye)(ye)發生重組(zu)、合并、分(fen)立等情(qing)況資質(zhi)(zhi)核定有關(guan)(guan)問題的(de)(de)通(tong)(tong)(tong)(tong)知(zhi)》(建(jian)(jian)(jian)(jian)(jian)市〔2014〕79號(hao))、《住房和(he)城(cheng)(cheng)鄉建(jian)(jian)(jian)(jian)(jian)設部辦(ban)(ban)公(gong)(gong)廳(ting)關(guan)(guan)于(yu)開展建(jian)(jian)(jian)(jian)(jian)設工(gong)程企(qi)(qi)業(ye)(ye)資質(zhi)(zhi)審批權限下放試點的(de)(de)通(tong)(tong)(tong)(tong)知(zhi)》(建(jian)(jian)(jian)(jian)(jian)辦(ban)(ban)市函〔2020〕654號(hao))和(he)《住房和(he)城(cheng)(cheng)鄉建(jian)(jian)(jian)(jian)(jian)設部辦(ban)(ban)公(gong)(gong)廳(ting)關(guan)(guan)于(yu)擴大建(jian)(jian)(jian)(jian)(jian)設工(gong)程企(qi)(qi)業(ye)(ye)資質(zhi)(zhi)審批權限下放試點范(fan)圍的(de)(de)通(tong)(tong)(tong)(tong)知(zhi)》(建(jian)(jian)(jian)(jian)(jian)辦(ban)(ban)市函〔2021〕93號(hao))同時廢止。《住房城(cheng)(cheng)鄉建(jian)(jian)(jian)(jian)(jian)設部關(guan)(guan)于(yu)簡化建(jian)(jian)(jian)(jian)(jian)筑業(ye)(ye)企(qi)(qi)業(ye)(ye)資質(zhi)(zhi)標準部分(fen)指標的(de)(de)通(tong)(tong)(tong)(tong)知(zhi)》(建(jian)(jian)(jian)(jian)(jian)市〔2016〕226號(hao))、《住房和(he)城(cheng)(cheng)鄉建(jian)(jian)(jian)(jian)(jian)設部辦(ban)(ban)公(gong)(gong)廳(ting)關(guan)(guan)于(yu)做好建(jian)(jian)(jian)(jian)(jian)筑業(ye)(ye)“證(zheng)照分(fen)離(li)”改革(ge)銜接有關(guan)(guan)工(gong)作的(de)(de)通(tong)(tong)(tong)(tong)知(zhi)》(建(jian)(jian)(jian)(jian)(jian)辦(ban)(ban)市〔2021〕30號(hao))與本(ben)通(tong)(tong)(tong)(tong)知(zhi)規定不一致的(de)(de),以本(ben)通(tong)(tong)(tong)(tong)知(zhi)為準。
